Picture yourself as the environmental supervisor at a textile dyeing plant on the edge of Bekasi regency, with the wall clock showing twenty to eight in the morning. A call comes in from the security post while you are still holding your coffee, saying that two environmental inspectors are waiting at the gate without any visit on the calendar. They want the IPAL logbook, the daily record of the wastewater treatment plant, six months of laboratory results and a sample from the outfall.
You open the filing cabinet and find a neat folder of stamped laboratory reports, and then your eyes stop on the daily flow column, which sits empty every Saturday and Sunday, and on last month's sample handover form, which seems to have gone missing somewhere.
In the third week of October 2026, judges, experts and environment officials gathered in Bali to discuss a question that reaches your filing cabinet. The 2026 Environmental Experts Forum, held by the Ministry of Environment and Environmental Control Agency (KLH/BPLH), placed scientific evidence and environmental restoration at the centre of enforcement. This article reads that shift from the plant's side, especially the monitoring data that many sites still treat as mere paperwork.
New Rules of Play
The foundation is still Law No. 32 of 2009 on Environmental Protection and Management, as amended by Law No. 6 of 2023 on Job Creation. Government Regulation 22 of 2021 brings those duties to the factory floor, with quality standards for wastewater and emissions and the duty to monitor and report them. For certain industrial sectors, Ministerial Regulation P.93 of 2018, amended by P.80 of 2019, requires continuous online wastewater monitoring, a system known locally as SPARING.
The rules on how the state supervises those duties changed earlier this year. Regulation No. 6 of 2026 of the Minister of Environment and Head of the Environmental Control Agency, on environmental supervision and administrative sanctions, was enacted on 25 May 2026 and took effect on 15 June 2026, according to the JDIH BPK legal database. It also revoked Ministerial Regulation No. 14 of 2024, which had covered the same ground.
InfoSAWIT reported that the new regulation splits supervision into two tracks with a different character. The regular track runs on a schedule through report reviews, virtual visits and field inspections, while the incidental track can be triggered by complaints or suspected violations. According to the same outlet, the minister can also take over supervision from regional governments when serious violations are found or when a region fails to supervise.
The sanctions remain tiered, covering written warnings, government coercion orders, administrative fines, and suspension or revocation of business licences. Rahmadi (2011) explains that administrative sanctions in Indonesian environmental law aim to stop the violation and restore conditions, which makes them more corrective than punitive.
This style of supervision has been visible in the field since the start of 2026. On 22 January 2026, KLH/BPLH shut down emission sources, namely boilers, furnaces and spray dryers, at eight companies in Jakarta, Bekasi and Tangerang after emission patrols across dozens of industrial estates, as reported by Katadata and Hukumonline. The ministry stressed that it stopped the emission sources rather than the whole operation, and the companies were given time to fix the problems. In February 2026, Kompas.com reported a similar halt of a paper mill boiler in Tangerang.
A Week in Bali
KLH/BPLH held the 2026 Environmental Experts Forum in Badung regency, Bali, from 19 to 23 October 2026, under a theme of restoration-oriented environmental law enforcement and climate justice through a stronger role for experts. According to the Supreme Court's official website, the forum has been an annual event since 2018. This year its working groups covered waste, mining, valuation of environmental losses, scientific proof in forest fire cases, and restoration.
The chief justice of the Supreme Court's civil chamber, Hamdi, gave the keynote address at the opening on 20 October. He said environmental enforcement must not stop at finding violations and imposing sanctions, because damaged environments must also be restored, as reported on the Supreme Court website. Hamdi pointed to Supreme Court Regulation No. 1 of 2023 on adjudicating environmental cases and to the certification of environmental judges, adding that rulings belong to judges while experts matter just as much.
Environment Minister Jumhur Hidayat carried a similar message at the same forum, as reported by ANTARA and Republika. He said the success of enforcement should be measured by whether damaged environmental functions recover, rather than by court verdicts alone. Jumhur also said that law without science would be blind and science without law would be paralysed, and he cast experts as the bridge between the two.
As an example, Jumhur referred to the government's lawsuit against six companies over damage to more than 2,500 hectares of land in North Sumatra, with a claim worth about Rp4.8 trillion according to ANTARA. Bisnis.com and RRI reported in January 2026 that the civil suits had been filed at several district courts, with the claim split between environmental losses and restoration costs. At the time of writing, we had found no reports of a final ruling in those cases.
In the second plenary session, Supreme Court Justice Syamsul Arief discussed the use of expert judgment as evidence in civil environmental cases, especially where no quality standard yet exists for a parameter. MARI News, the Supreme Court's news channel, reported that he stressed scientific testing of expert opinion, based on scientific grounds and reasoning that others can check. He also asked that regulators, experts and judges keep their roles separate, so no party stretches beyond its authority.
This direction had drawn critical comment well before the forum opened in Bali. In April 2026, Mongabay Indonesia reported a Greenpeace Indonesia campaigner saying that administrative sanctions and fines had not yet deterred damage, and an environmental law expert from Universitas Indonesia arguing that fines fall short without a clear restoration order.
Valuation of environmental losses, one of the forum's topics, has had a guideline for years in Minister of Environment Regulation No. 7 of 2014. Such calculations rest on data such as how long pollution lasted, how much load was discharged and how much area was affected, so a plant's own records can shape the final number.
Back at the Gate
Back to you in front of the filing cabinet, the morning feels different once you follow the conversation in Bali. The empty weekend flow column is no longer a matter of tidiness, because someone else can read that gap as two days without control that you cannot prove otherwise.

Monitoring data works like the cash book at a shop till, which only means something when it is counted at shift handover and matches the money in the drawer. A neat lab result that does not match the flow records, the treatment plant's operating hours or the chemical usage looks like a cash book written beautifully and never counted again.
When the inspectors take their own sample back to their laboratory, their numbers will be set beside the numbers you keep. Any gap your operating records cannot explain becomes the first question, through either the regular or the incidental track.
Steps for Plants
These steps can start before any inspector arrives, and most need only disciplined record keeping and one walk around the treatment area.

- Map every monitoring duty from your environmental approval, technical approvals and SLO, the operational feasibility letter, into one register with parameters, frequency, sampling points and owners.
- Reconcile laboratory results every month against flow records, operating hours of the treatment plant or emission controls, and chemical usage, then write an explanation for every gap.
- Protect the sample chain of custody through sampling forms, sealed containers, storage temperature records and receipts from an accredited environmental laboratory.
- Calibrate flow meters, SPARING sensors and CEMS, the continuous emission monitoring systems on stacks, on the required schedule, and keep the calibration records where anyone can find them quickly.
- Record operating upsets, such as a failed treatment pump or a leaking dust filter, on the same day, together with the corrective action and any report the authority requires.
- Name an inspection escort for every shift, a person who knows where documents are kept, can open restricted areas and records conditions when samples are taken.
- Run internal audits with an inspector's questions, for example asking the team to prove the March figures within half an hour, instead of only checking that documents exist.
- Review your environmental approval whenever the process, raw materials or capacity change, because data that suited the old document can mislead for the new operation.
ISO 14001:2015 has long asked organisations to monitor, measure and keep documented information as evidence of monitoring results, including making sure measuring equipment is calibrated. Plants running ISO 14001 can start there, provided their audits test whether the data agrees and not just whether forms exist.
Where Nusa Safety Helps
Our Environmental Compliance and PROPER service helps build a register of obligations from your environmental approval, a monitoring calendar and an organised evidence file for supervision and the PROPER rating. For sites whose treatment plant, stack or hazardous waste store has changed, support with Pertek and Rintek aligns the technical documents with what is actually installed. Approvals and SLOs are always issued by the competent authority, and our role is to support the preparation of documents and the data behind them.
Companies whose documents lag behind their operations can review the AMDAL, UKL-UPL or SPPL route or the DELH and DPLH route with the agency. An ISO gap assessment and internal audit tests whether your ISO 14001 system can prove its numbers, and HSE digitalisation helps move paper logbooks into records with a time stamp.
Treatment plant operators can use Hazard Report to report upsets from a phone and follow each corrective action to closure, while APEX Risk brings environmental risks into the same register as your other risks. We cannot guarantee the outcome of any inspection or PROPER rating, and you can start a first conversation about your plant through our contact page.
Before Inspectors Leave
Back at the dyeing plant in Bekasi, the two inspectors leave before noon with sealed sample bottles and copies of several documents, and you know their results will soon sit beside the records you have kept for months.
The forum in Bali sent a message that reaches your office too, because environmental enforcement now leans more on scientific evidence and asks more often for restoration. This afternoon you can start small, by filling the weekend flow column with a duty roster and a meter someone actually reads.
This article is general information and not legal advice, so please discuss how the rules apply to your specific case with a lawyer or the competent environment authority.
